1. Identification and Contract of the Contracting Entity:

2. Object of the Tender:
The contract includes the Engineering (design works, manufactorization, inspection, Installation, Comissioning, testing, Electrical and mechanical works, and other related works to Engineering works), Procurment Supply for all the materials and equipment, substation automation interface with the existing system. Therefore, the EDTL, E.P. would like to invite eligible company to submit their bids for the above-mentioned tender (the Contract) through a fair, transparent and competitive bidding process in accordance with the Timor-Leste Law and international best practices (Bidding Process);

3. Type of Procedure:
The tender adopted a two-envelope system wherein the Bid comprises two envelopes submitted simultaneously, one containing the Technical Bid and the other Price Bid, enclosed together in a sealed outer envelope. Participation for this bidding is open to all eligible international & national bidder;

4. Value of the Procurement:
The maximum budget for this project is US$ 18,339,225.89;

5. Bid quoted exeeds maximum budget shall rejected;

6. Proposals with a value does not reach 70% of the value of the procedure is considered abnormally low bid:

9. Duration of the Contract: 18 months;

10. Required qualification and qualification documents:
The eligible company shall meet the following minimum qualification criteria;

a) Contract of Similar Size and Nature:
Specific Construction Experience (Contracts of Similar Size and Nature) at least two (2) similar contracts of 110 kV or above voltage AIS/GIS Substation satisfactorily completed / substantially completed as a prime contractor, joint venture member, management contractor during the last Seven (7) years where the value of participation in each contract is at least USD 13,500,000.00 the Contract price.

Document Required: Certified true Copy of the Certificate of Completion or Acceptance/ Taking-Over Certificate/ Substantial Completion for the contracts submitted as successfully completed. (English Translation, if the original documents are not in English);

b) Financial Capacity
Cash Flow Capacity:
The Bidder must demonstrate access to financial resources such as availability of cash in bank, approved line of credit and other financial means, other than any contractual advance payments for its current works commitment to meet a cash-flow requirement at least USD 9,000,000.00 the Contract price of and its current works commitment.

c) For all the company either International or Local which have been awarded the project by EDTL-EP and the Progress is on-Going or physical Project Engagement with the Progress of less than 80% shall be eliminated at the Preliminary stage.

d) For those Companies are providing Technical Service Contract to the Employer (EDTL, E.P.) are not allowed to participate in this bidding process

e) There is a few minimum requirement as describes in the Tender Document

12. Price of the Tender Document:
The bidding document (PDF copy in USB) can be purchased by interested Suppliers through filled up a form issued by procurement division to the address below and upon payment of a non-refundable fee of One Hundred US Dollars (US$100.00) by Bank demand draft in favor of the EDTL E.P to the one of the following Bank Account:

1. Bidding Document can be obtained from 15 May 2024 at EDTL, E.P. office at working hours;

2. Place, date and time of the pre-bid meeting:
A pre-bid meeting shall take place at the following date, time and Place:

Attending the Pre-Bid meeting by a bidder is optional. If a bidder does not attend the Pre-Bid meeting, the bid will not be rejected on the ground of non- attendance of the meeting;

3. Deadline of submission of bids:
The bid must be received in the Tender Box located at the same address specified above no later than 10:00 hour’s local time on 24 June. Late bids will be rejected;

The Employer will not be responsible for any cost or expenses incurred by bidders in connection with the preparation of delivery of bids;

4. Tender Bid Opening:
Technical bids will be opened immediately after the closing time for the submission of the bids at the same address specified above in the presence of bidders who wish to attend;

5. Bid Security:
Bids must be accompanied by a Security in form of Bid Securing Declaration;

6. Performance Security and Quality Security:
The winning Bidder will be required to submit 5% of Performance Security from the value of the Contract. Additionally, during contract implementation, the winner will be subjected to a quality guarantee in the form of retention of 5%. In case of Abnormally low bid the Performance Guarantee shall be 10%;

The Performance Guarantee must be submitted to the Competent Entity at least 5 days before the execution of the Contract in the form furnished in the Bidding Documents;

7. Minimum Period Validty of Tender Document:
The validity of the document shall be 120 days;

8. The Award Cirteria:
The best technical quality and value for Money with final rangking of ratio 70% for Technical and 30% for Price;

9. Obligation to pay the taxes:
The supplier is required to pay all the applicable taxes in accordance with the applicable law.
